1. Acceptance of Terms

By accessing and using Applites ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Applites provides website monitoring and uptime tracking services. The Service includes:

  • Real-time website monitoring
  • SSL certificate monitoring
  • Performance analytics
  • Incident management
  • Alert notifications via email
  • Screenshot capture on errors

3. User Accounts

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your account information
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access or security breaches

4. Acceptable Use

You agree not to use the Service to:

  • Monitor websites you do not own or have permission to monitor
  • Attempt to interfere with or disrupt the Service or servers
  • Use automated tools to abuse the Service
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others

5. Subscription Plans and Payments

Applites offers various subscription plans:

  • Free Plan: Limited features at no cost
  • Paid Plans: Full access with monthly or annual billing

By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your selected plan
  • Provide valid payment information
  • Automatic renewal unless you cancel before the renewal date

6. SMS Notifications and Credits

SMS notification services are available on Starter and Professional plans, subject to the following terms:

  • Starter Plan: Includes 50 SMS notification credits per calendar month
  • Professional Plan: Includes 100 SMS notification credits per calendar month
  • Free Plan: Does not include SMS notification credits

SMS Credits Policy:

  • SMS credits are allocated at the beginning of each calendar month
  • Unused credits expire at the end of each calendar month and do not roll over to the following month
  • Credits cannot be transferred between accounts or redeemed for cash value
  • Once your monthly SMS credits are exhausted, you will continue to receive email alerts, but SMS notifications will be paused until your credits reset the following month
  • If you upgrade or downgrade your plan mid-month, your SMS credits will be adjusted immediately to reflect your new plan's allocation
  • If you cancel your subscription, any unused SMS credits are forfeited

We reserve the right to adjust SMS credit allocations with 30 days' notice to users.

Notification Delivery Disclaimer:

Email and SMS notifications are sent on a best-effort basis. Applites cannot be held responsible for undelivered, delayed, or failed notifications due to factors including but not limited to: email service provider issues, spam filters, SMS carrier network problems, invalid contact information, telecommunications outages, or third-party service disruptions. Users are responsible for ensuring their email addresses and phone numbers are valid and properly configured to receive notifications. We strongly recommend monitoring your websites through multiple channels and not relying solely on notifications for critical alerts.

7. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We offer refunds on a case-by-case basis within 30 days of purchase.

8. Service Availability

While we strive to provide 99.9% uptime, we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Emergency repairs
  • Force majeure events
  • Internet connectivity issues

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in our Privacy Policy to provide and improve the Service.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Applites and are protected by international copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

To the maximum extent permitted by law, Applites shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless Applites and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.
